Updated Mar 11, 2016 at 4:11 PM The Beach Council unanimously approved a resolution calling for the transfer of $800,000 from the city’s reserves to pay for the road, which will connect Fairway Boulevard to Nautilus Street.

The transfer will whittle away more than a third of the city’s reserve funds used for emergencies and unexpected expenses.

Public Works Director Paul Casto said the $800,000 should be enough to pay for the road. Construction could start in May and be completed by the end of the summer.

Colony Club residents have been lobbying the city for years for another exit out of their community. City officials have said if Colony Club was built today, the city would have required two exits.

Residents said the existing single exit through a median cut on Back Beach Road is a traffic hazard. Vehicles turning in different directions often stack up and block the view of oncoming traffic.

The city also has spent $50,000 to purchase a 40-foot by 125-foot property at 229 Fairway Blvd. The exit will connect Fairway Boulevard to Nautilus Street behind Nautilus Cove Apartments and Carrabba’s Italian Grill.

The St. Joe Co. has donated the land and the city must pay $50,000 in mitigation.

PANAMA CITY BEACH — The Beach should be able to weather the expected plunge in March sales tax revenues resulting from a reduction in Spring Break business, city officials said.

The reason: Gross receipts tax revenues are increasing in the other months of the year, they said, and should more than make up for any March shortfall.

The 1 percent tax on goods sold in Panama City Beach is the biggest source of income to the Beach’s general fund budget. The tax has increased for the first five months of this fiscal year, which began in October. Through February, the tax had brought in $6.7 million. That’s about a third of the total brought in fiscal year 2014-2015, and the busy summer months are still ahead.

Last year, the tax brought in $9.73 million to city coffers.

Even with an anticipated slow Spring Break this year, the city’s annual tax revenues still could exceed last year’s, City Budget Director Holly White told the Panama City Beach Council on Thursday.

“If things hold the way that they are going now, chances are we will hit $10 million this year,” she said. “We are up every month, consistently, year to date through five months, up 12 percent. We’ll have to see what happens with the spring, obviously.”

City officials have been carefully monitoring their finances, with hotel reservations down more than 50 percent this Spring Break and businesses reporting sales down anywhere from 50 to 85 percent.

Businesses say the reduction is due to new laws passed to tone down the celebration, particularly the law banning drinking on the beach in March. But Bay County Commissioner Mike Thomas said the primary reason for the decrease in visitors is the bad publicity about crime from last year’s Spring Break.

Whatever the case, city officials said they are definitely expecting a drop in tax revenues — perhaps by 50 percent or more — with fewer visitors in March, and they are keeping a close eye on revenue streams.

In fiscal year 2014-2015, $970,846 was collected from the gross receipts tax in March, making it the fourth highest month of the year behind June, July and August.

Councilman John Reichard said Friday he expects the gross receipts tax revenues for March to be down by at least 50 percent. That could translate into a more than $47 million drop in retail spending at local businesses for the month based on last March’s numbers.

The tax money “is going to be down like crazy, but the first five months of our accounting year are going to pick up the slack, so for the year that ends Sept 30, we’ll probably be on target where we were last year,” Reichard said. “That’s what I’ve been told” by staff.

PANAMA CITY — Laws aimed at taming the raucous party atmosphere of Spring Break will remain in place as Panama City Beach gears up for the annual migration of thousands of high school and college revelers, a federal judge ruled Friday.

U.S. District Court Judge Mark E. Walker, who heard almost eight hours of legal arguments in the federal Spring Break lawsuit last week, said issues raised by pro-Spring Break businesses in their request to delay implementing laws that regulate the sale and consumption of alcohol were not sufficient to warrant an injunction, according to court documents.

“Although plaintiffs’ claims are not without merit, they are not substantially likely to succeed on the merits of any of those claims and are thus not entitled to a preliminary injunction,” Walker wrote of the decision.

The ruling’s effects on the lawsuit filed by the businesses were unclear Friday. Attorneys for the city declined to comment on the future of the case, saying only that Walker’s opinion indicated there is not a substantial likelihood the complaint would prevail in court.

Luke Lirot, attorney for the businesses, could not be reached for comment Friday.

Panama City Beach City Manager Mario Gisbert said the decision affirmed the Beach was in the right all along.

“We try to do everything by the book,” Gisbert said. “We felt the entire time that we had done everything we could to follow the regulations and not do anything that was incorrect to any one individual at all.”

Gisbert added that the city has been planning events for Spring Break, which usually commences near the end of February, and the level of law enforcement presence on the Beach will be equal to that of last year.

“We cannot let down our guard thinking that the rules will do everything,” he said. “We have to have the police there to enforce them.”

The Bay County Sheriff’s Office put word out on social that the beach-drinking ban will be enforced by arrest, and Maj. Tommy Ford said “people should know what the rules are.”

‘Racial animus’

Panama City Beach businesses Club La Vela, Harpoon Harry’s and Spinnaker Beach Club had asked for the injunction on eight counts of their 15-count lawsuit against the city. The lawsuit claims that while adopting laws to tame the annual party, city officials infringed upon several constitutional rights of the businesses and that the laws were influenced by “racial animus.” City officials contested the laws do not target any specific racial group but instead are meant to deter dangerous or criminal behavior. They also argued that laws regulating alcohol possession and consumption were an exercise of their constitutional rights.

Panama City Beach Officials Vote To Ban Boozing On Beaches During Spring Break

While there is a distinct pleasure in burying your toes in warm sand while sipping on a cold alcoholic beverage, city officials in Panama City Beach, FL have decided to crack down on the booze-fueled beach shenanigans commonly exhibited by college students on spring break, after a spate of negative publicity this year. To put it plainly: No more drinking on the beach in the month of March.

The sands of Panama City Beach’s beaches will be a bit quieter next year, as the city’s Beach Council voted unanimously yesterday to ban alcohol on its sandy stretches next spring break, reports the Panama City Herald.

Other ordinances were also approved in a first reading (that still must become final) in an attempt to tamp down the rowdiness of the season, including rules that would close bars at 2. a.m., ban open containers of alcoholic beverages in commercial parking lots unless under the surveillance and control of the business, and outlaw parking on right of way after dark.

The council also voted to designated the entire month of March as officially Spring Break as it applies to those laws.

Local officials are seeking to clean up the city’s image after this most recent spring break, when seven partiers were shot and injured at a party, and an alleged sexual assault on the beach behind a popular nightclub — in broad daylight — was reportedly caught on camera and reported widely in the media.

For the drinking ordinance to become law, it will have have to be brought back for two council votes.

UPDATE: UF suspends frat over harassing wounded veterans

GAINESVILLE — Already on a one-year probation for hazing, the Zeta Beta Tau (ZBT) fraternity at the University of Florida has been suspended following reports its members yelled at and spit on wounded military veterans vacationing in Panama City Beach last weekend.

The fraternity has been charged with several offenses as part of the university’s formal investigation into “allegations of disturbing behavior toward veterans,” officials said in a news release issued late Friday afternoon.

The university has charged the fraternity with “causing physical or other harm, obscene behavior, public intoxication, theft and property damage.” ZBT is suspended from all activities pending the outcome of a complete investigation.

“I am personally offended and disappointed by the behavior that has been described to me,” said David Kratzer, a retired U.S. Army general and UF vice president of student affairs. “This is not representative of our students or of the university.”

Since the incident in Panama City Beach was reported, three students have been expelled from the fraternity, with a promise that more disciplinary action will be taken if the fraternity finds out others were responsible. The identities of the students were not released.

PANAMA CITY BEACH — Seven people were wounded, several critically, in a shooting at a Spring Break house party early Saturday.

David Jamichael Daniels, 22, of Mobile, Ala., has been charged with seven counts of attempted murder and was in the Bay County Jail awaiting first appearance. Daniels was out on bond for drug possession in Alabama when the shooting occurred, McKeithen said at the press conference.

The shooting occurred at 5312 Thomas Drive on the east end of the street shortly before 1 a.m., according to the Bay County Sheriff’s Office.

“Three victims were found in the home, one in front of the house, one in the median of Thomas Drive, and two across the street from the home,” according to a news release issued later Saturday morning.

“It was a house party and there were a large number of people there,” Sheriff Frank McKeithen said.

Investigators still did not have a motive for the shooting Saturday afternoon.

BofA wants its unit 701 Back - Sues NCC

Nautilus Cove Condo has now been filed on in a Foreclosure action by the Bank of America who are attempting to take back #701 the condo that NCC recently acquired via our Foreclosure action against Jarrett.

You might recall that NCC had filed 12/12/11 for Foreclosure on the #701 Jarrett unit for unpaid association dues. The unit went through foreclosure, auction and we have just obtained a 'deed' on 6/21/12 to the unit.

Bank of America now moves to recover their unit from:
Jarrett (now gone), Unknown Tenants and Nautilus Cove Condo Assn.
(BOA took over from Countrywide and the original note on #701 was $166,426 on 2/22/07, now BOA wants the unit which we 'in theory' own)

This filing means more legal costs to us at NCC as BOA will take back the unit from us and whatever tenants we are renting to will be evicted.

At least in regard to the #701 unit this whole nonsense has proved to be a total waste of time on our part. To at least 'break even' on the matter we would have to have rented out the unit for 18 months, clearly this is unlikely.

1st time I was in PCB/PC was via Greyhound to Spring Break 1965 then I was not there until 2006 when I rented a condo at 2100 Beach Blvd.

PANAMA CITY — Bay County commissioners on Tuesday approved code changes to tone down Spring Break that mirror those passed by Panama City Beach but not before venting their frustration that the city didn’t go far enough.

Commissioners approved closing down all bars in the unincorporated area at 2 a.m. in the month of March, just as the Panama City Beach ordinance calls for within city limits. But commissioners Tuesday also questioned why the early closing times are only in March when Spring Break lasts several weeks longer than that.

“Why is it just March?” Commissioner Bill Dozier asked. “I don’t understand that instead of just the full Spring Break.”

Commissioner Mike Thomas, whose district covers the beach, replied: “I don’t understand it either, but that’s what they voted on.”

He said he was surprised when the Beach City Council only scaled back the hours in March.

“But I’ve been surprised several times lately over this,” Thomas said. “When they ask for a recommendation from the sheriff and they got it, they didn’t exactly follow it, and that surprised me.”

708? Now that is a familiar unit number, where did I hear of that before??

Oh yeah, I use to own it until I sold it back to the developer, furnished, for $93,000. Then it got rented out to Nicholas Boos, native of PCB and former Dave and Busters employee. Now evicted from my old unit.

Couldn't care less, I'm just glad I'm out of Nautilus Cove. You can see the quality of renters that Concord Management lets into NCC.

NCC is next to the referenced strip mall and 'if' any NCC residents had a golf cart they could use it to cross over to the Bid A Wee area and go to the beach or shops on Front Beach Road and even travel to the shops at Pier Park.

The number of residents who might take advantage of such a crossing would probably be somewhat limited as both the costs of a golf cart and a place to park it would require some serious thought both by the resident and the association.

WHEN MEETINGS TURN INTO BOXING MATCHES!

Most of us have seen association meetings getting very emotional. That’s no miracle since the topics of home and money stir up minimum as many emotions in human beings as religion and politics.

Shouting matches are actually pretty common in such meetings. I have watched many videos of meetings of board and/or membership meetings turning pretty wild. I guess some folks wish they would have never said what was shown on tape if they watch it a day later. Too many people are making an a.. out of themselves at such meetings. Never forget: Civilized meetings definitely create better results!

But not all heated discussions just end in verbal exchanges with lots of screaming and yelling.

Some of these emotional discussions actually don’t stop with threats, some really turn physical. Over the years there have been many reports in the media about actual fights at such meetings and people even going to jail over it.

I still remember the story from Ocala where two homeowners attacked a representative of developer Zacco at a meeting of concerned owners (see: Meeting turns violent; two arrested). For these two the meeting ended in jail. It seems the name Zacco stirs up lots of emotions in Ocala ’s communities as we could see at a recent HOA meeting organized by the Division and Senator Hays. I think most owners in that area feel that the police should rather arrest some Zacco family members instead of homeowners.

It doesn’t happen too often that such meetings turn violent, but most often it is foreseeable that it might happen. There are a lot of warning signs popping up before such confrontational meetings! And the people in charge should take notice – before somebody ends up in the hospital or the jail.

Sometimes an off-duty police officer in uniform will stop the feuding parties from getting physical.

But police officers can as well create a lot of havoc at owners’ meetings. Remember the case of the Fontainebleau Terrace Owners’ Association in Panama City Beach , where police officer Donald Nichols, in an attempt to help his “buddy” Cam Ray McDonald, actually started the violence and arrested a condo owner, injuring others? (THIS IS A CONDO BUST -- NOT A DRUG BUST!). The police department was sued and police officer Nichols resigned. But guess what: He became a licensed CAM (License Number CAM36678*). I guess he chose that profession in order to be able to continue his bullying tactics?

But in most instances hiring a police officer will guarantee a more peaceful meeting – meaning the expense of paying an officer to be present at the meeting pays dividend. Shouldn’t we all be able to look forward to a nice community meeting without screaming, yelling or even a brawl?

Stang v. City of PCB and Donald Nichols

I was looking for that Fontainebleau Terrace case in the Federal Civil filings for the N. District of Florida, but seems it never made it to Federal Court.

I did find a 2006 case where the mother of a man that Donald C. Nichols arrested sued both the PCBPD and Nichols as her son eventually killed himself, all the charges had by then been dropped from Felony to Misd then dropped all together. The arrest was so baseless no one would take it to court.

The Civil Counts charged were:

1 False Arrest/False Imprisonment

2 Battery

3 Excessive Force

4 Negligent Hiring/Retention/Supervision

("Defendant City knew or should have known of Defendant Nichols' propensity to violate the rights of detainees and to use excessive force.")

The civil case was settled for the mother and estate, no idea what the award was.
